WEAR YELLOW FOR SETH respects the copyright of others, and we expect the same respect for our own work. As an independent general-news publication, we quote, link, and report constantly, and we do that within the ordinary rules that allow news reporting and fair quotation. If you believe material on wearyellowforseth.com infringes a copyright you own or control, this page tells you exactly how to ask us to take it down, and how someone can respond if they think a takedown was a mistake. We follow the standard notice-and-takedown framework that most publishers use, adapted to the applicable law where we are registered.
Before you send a notice
News reporting often uses short quotations, brief excerpts, screenshots, and references to other coverage. That kind of use is generally allowed under the principles that protect quotation and reporting, and it is a normal part of how journalism works. A headline and a link back to a source is not infringement. Before sending a formal notice, it is worth considering whether the use you are objecting to is a limited quotation for reporting or comment. If you are unsure, you are welcome to write to us first and explain your concern, and the desk will look at it.
How to send a takedown notice
If you still believe your work has been used without permission, send a written notice to support@wearyellowforseth.com with the word COPYRIGHT in the subject line. To be effective, your notice must include all of the following:
- Identify the copyrighted work you say has been infringed. If several works are involved, list them.
- Identify the specific material on our site that you say is infringing, and give the exact URL or URLs where it appears so our team can find it.
- Give your contact details: full name, a mailing address, a telephone number, and an email address where we can reach you.
- Include a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- Include a statement that the information in your notice is accurate, and that, under penalty of perjury, you are the copyright owner or are authorised to act on the owner’s behalf.
- Add your physical or electronic signature.
A notice missing these elements may be delayed or ineffective, so please include everything. Sending a knowingly false claim of infringement can carry legal consequences for the sender, so make sure your notice is honest and complete.
What we do when we receive a valid notice
When a complete notice arrives, our team reviews it and, where the claim is proper, we remove or disable access to the material in question, usually within a reasonable time. We may also let the person who posted or supplied the material know that we acted, and pass along your notice so they can respond if they wish. We may decline to act on a notice that is plainly incomplete, mistaken, or aimed at ordinary quotation and reporting, but we take every genuine complaint seriously.
Counter-notification
If you are the person whose material was removed, and you believe the removal was a mistake or that you have the right to use the material, you may send a counter-notification to support@wearyellowforseth.com, again with COPYRIGHT in the subject line. A valid counter-notification should include:
- Your name, address, telephone number, and email address.
- Identification of the material that was removed and the URL where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the appropriate courts where we are registered, or the applicable courts for your address, and that you will accept service of process from the party who filed the original notice.
- Your physical or electronic signature.
Once we receive a valid counter-notification, we may forward it to the original complainant. Depending on the applicable law and what the parties do next, we may restore the material after a reasonable waiting period unless the complainant tells us they have started legal action to keep it down. We are a messenger between the two sides here, not the judge of the underlying dispute.
Repeat infringers
We have a policy of dealing with repeat infringers. If someone repeatedly posts or supplies material that infringes the copyright of others, we may remove their content, block their access, and, where relevant, close any account or standing they have with us. Persistent infringement is not something we tolerate, whichever side it comes from.
Fair use, news reporting, and quotation
Copyright law makes room for news reporting, commentary, criticism, and limited quotation. Our journalism relies on that room, and so does everyone else’s. Quoting a sentence, citing a study, describing what a document says, or linking to a source is a normal and lawful part of reporting. If your objection is really to the fact that we reported on something rather than to a genuine copying of your protected expression, a takedown notice is the wrong tool. In that case, please use our contact page and tell us what the issue is, and we will look at it fairly.
A note on our own work
The same principles protect WEAR YELLOW FOR SETH. Our reporting is ours or our licensors’, and republishing whole articles without permission is not allowed, as set out in our terms of service.
